Changes to PKP PLK price list not approved

The President of the Office of Rail Transport refused to approve the draft price list of the Polish national infrastructure manager, PKP PLK, in the part on the method of calculation of unit rate of basic and shunting fee. It means that for 2022/2023 timetable PKP PLK may use the existing price list or prepare a new one and resubmit it to the President of the Office of Rail Transport for approval.

The President of the Office of Rail Transport in the decision stated that the infrastructure manager failed to:

  • introduce a part of the unit rate connected with type of performed transport services (mark-up) despite the reasons which make its application impossible;
  • indicate the legal basis justifying application of multiple adjustment of factors differentiating average rate depending on the category of railway line and weight of train for trains with commercial stops at platforms as well as lack of substantive justification of such solution.

Due to correlation of shunting fee with basic rate, the President of the Office of Rail Transport also refused to approve the method of determining shunting fee applied in the draft price list.

The infrastructure manager may decide to apply for 2022/2023 timetable the price list in force for the previous timetable (which is the price list approved in 2018) or to draft a new price list and resubmit it to the President of the Office of Rail Transport for approval (Article 33.18 of the Railway Transport Act 2003). The notification on decision by the manager or a new draft price list should be submitted to the President of the Office of Rail Transport within 30 days from the day of the decision refusing to approve the draft price list (Articles 33.19 and 33.20 of the Railway Transport Act 2003).

The decision was published in the Official Journal of the President of the Office of Rail Transport.
