OT Rail sp. z o.o. without safety certificate.

President of the Office of Rail Transport (UTK) has refused to prolong the validity of the OT Rail sp. z o.o. company’s safety certificate part A. This decision means that the company, starting 23 May 2019, may not conduct any transport activities within the Polish railway system.

The President of UTK has refused to issue the safety certificate, as it was established that the safety management system of the railway transport of the railway carrier OT Rail does not comply with the criteria set in the Commission Regulation (EU) No. 1158/2010. Controlling activities conducted on the grounds has established many irregularities, which had not been removed until the decision has been issued.

The company has not performed activities of a railway carrier for more than 12 months.

The safety certificate part A confirms the introduction by a railway carrier of a safety management system adequate to the type of performed activities. During the process of issuing of such a certificate the certifying entity (in case of Poland the President of UTK) verifies first and foremost the fulfilment of legal regulations stemming from the Annex II to the Commission Regulation (EU) No. 1158/2010, in the scope of the structure and content of the safety management system adopted by the railway carrier and the requirements stemming from the national law.
